helium balloon have agreed to plead guilty in a deal that could send them both to jail but protect one from deportation.\u003cbr/\u003eThe married couple were seen at the Larimer County courthouse completing paper work on Thursday and their attorney David Lane said that Richard Heene would plead guilty to a felony, attempting to influence a public servant.\u003cbr/\u003eHeene's wife, Mayumi, a Japanese citizen who could be deported if convicted of more serious charges, will plead guilty to a lesser charge of false reporting to authorities, a misdemeanour.\u003cbr/\u003eLane said the threat of deportation \"fuelled\" negotiations with prosecutors. \u003cbr/\u003eAn attorney for Mayumi said her immigration status was a factor in reaching the deal but would not comment further.\u003cbr/\u003eProsecutors announced criminal charges against the couple on Thursday. \u003cbr/\u003eThe couple are expected to appear in front of a judge on Friday after voluntarily going to the court house on Thursday.\u003cbr/\u003eA spokeswoman for the Larimer County district attorney's office would not discuss whether a plea agreement had been reached.\u003cbr/\u003eThe October 15 saga gripped a global audience, first with fear for the safety of six-year-old Falcon Heene and then with anger at his parents when authorities accused them of perpetrating the hoax to drum up attention for a possible reality show.\u003cbr/\u003eLane said the deal does not call for removing Falcon or the couple's other two children - aged 8 and 10 from the parents' custody.\u003cbr/\u003eThe plea deal would spare the Heenes the maximum jail time, but Richard Heene could still get up to 90 days and Mayumi up to 60, Lane said.\u003cbr/\u003eWithout the deal, the charge against Richard Heene carries a possible sentence of two to six years in state prison and a fine of up to 500-thousand US dollars. \u003cbr/\u003eThe charge against his wife is punishable by up to six months in the county jail and a fine up to 750 US dollars.\u003cbr/\u003eMayumi Heene's attorney, said he expects her to serve any jail time in a work-release programme that would involve some detention and some time at home.\u003cbr/\u003eThe parents still face a civil investigation by the Federal Aviation Administration. \u003cbr/\u003ePossible penalties range from a letter of reprimand to a fine.\u003cbr/\u003eThe balloon briefly forced some planes to switch to a different runway for takeoff from the Denver airport.\u003cbr/\u003eLane said prosecutors insisted on a \"package deal\" that required Richard Heene to plead guilty to a felony so Mayumi Heene could plead guilty to a misdemeanour and avoid deportation.\u003cbr/\u003eOn the day in question, the couple made frantic calls to authorities, saying they feared Falcon might be aboard a homemade balloon that had escaped from their backyard in suburban Fort Collins. \u003cbr/\u003eThat triggered a frenzied response by emergency crews before the balloon landed in a dusty farm field without the boy inside.\u003cbr/\u003eThe Heenes said they later found Falcon hiding at home.\u003cbr/\u003eRelief soon turned to suspicion. \u003cbr/\u003eDuring a live interview on CNN hours after the balloon chase, Falcon looked to his father and said, \"you had said that we did this for a show.\"\u003cbr/\u003eThe Heenes' lawyers expect prosecutors to seek restitution in the case. \u003cbr/\u003eLocal and federal authorities spent at least 62-thousand US dollars chasing the balloon and then searching for Falcon after it landed.\u003cbr/\u003eThe Heenes are amateur storm chasers and had twice appeared on the US television reality show \"Wife Swap.\" \u003cbr/\u003eFormer business partners said Richard wanted a show of his own called \"The Science Detectives\" or \"The Psyience Detectives.\"\u003cbr/\u003eRichard denied the saga was a publicity stunt. \u003cbr/\u003eTwo days later, deputies questioned both parents separately, and authorities said Mayumi admitted the incident was a hoax.\u003cbr/\u003eAccording to an affidavit, Mayumi Heene told an investigator the couple devised the hoax two weeks before the flight \"to make the Heene family more marketable for future media interest.\" \u003cbr/\u003eShe said they built the balloon specifically for that purpose.\u003cbr/\u003eMayumi Heene , 45 years-old, also said she and her husband had instructed their three children to lie to authorities and the media, the affidavit said.\u003cbr/\u003eLane said on Thursday that Mayumi Heene's statements could have been used to convict her but could not have been used against her husband because of marital privilege, which can keep a person's spouse from testifying against him or her.\u003cbr/\u003eHe
