STORY-LINE:On the night of her wedding, 21-year-old Shagufta Sayyd's husband revealed to her that he was having an affair, and that she couldn't stay with him. She is now back home with her mother. Sayyd still uses her marital surname. \"He told me he had an affair with someone else on the first night of our marriage. He said you have come here because my mother likes you, but I cannot keep you here,\" she says. \"I asked him whether you want to keep me or not. He said no I don't want to keep you. I want to divorce you. So he said divorce, divorce, divorce thrice and that was it.\"In India, where the majority of the 170 million plus Muslims are Sunni, Muslim Personal Law, like other religious personal laws, grants special rights and procedures to people of the Islamic faith.However, some Muslim women are battling the patriarchal laws, specifically the practice of men divorcing their wives by simply uttering the words talaq (divorce) three times. Muslim women have no right to initiate such divorce and with the exception of a small payment for the first three months, they cannot claim any alimony from their former husbands. Noorjehan Safia Niaz, co-founder of Bhartiya Muslim Mahila Andolan (BMMA) or Indian Muslim Women's Movement, has been fighting for equal laws for Muslim women for the past six years.In June, BMMA  spearheaded a nationwide mass-signature campaign, collecting more than 50,000 signatures of Muslim women and men to call for a ban on triple talaq. \"They have been divorced by speed post, by sending out letters. Some have just simply said talaaq (divorce) three times and the divorce has happened. There are cases where women don't even know that they've been divorced,\" Niaz says.\"They don't even get maintenance from their husbands, the children are without any support. So, it has become very convenient for Muslim men to just say talaaq (divorce) thrice andÃ¢Â€Â¦ it is just so easy for him to get the woman out of his life.\" Legal experts say triple talaq, is unconstitutional and that the Supreme Court has been pushing for uniformity in laws.\"Sizable number of the Muslim women now want a great change in their society, in their laws,\" says Kamlesh Jain, an advocate in the Supreme Court. \"They see that other Hindu women, or the Christian women, the rest of the population of the country is getting all the benefits of laws, protection of laws, and security of life also. So they are very much frustrated.\" According to Niaz, a grey area in the Muslim personal law is that it is open to interpretation and not codified. So while she considers triple talaq \"un-Quranic,\" some religious bodies and Islamic schools vouch for it's legality and urge Muslim women to leave Islam if they don't like its laws.\"What is these women's status? What is their capacity? Just by branding together some 400-500 womenÃ¢Â€Â¦ If you don't like Islam's law, then go away and join any other religion. Become Hindu. Become Christian. Become Jewish. Go anywhere,\" says Mohammed Saeed Noori, a Muslim cleric from the Raza Academy. But Noori warns that the rule is not supposed to be that men are allowed to say 'I divorce you' three times in the same breath. \"Don't give three (divorce) altogether in one go. People who do that are doing it wrong. But, if he says it thrice. If he says it thrice then the divorce is immediately confirmed. Then that women has to immediately leave his house.\"In 1985, the Supreme Court had passed a judgement in favour of Shah Bano, a 62-year old woman who had been divorced and abandoned by her husband, and was seeking alimony. The government of the time however, passed a law to protect the Muslim divorce law, thereby overturning the top court's judgement. Jain believes India should follow in the steps of other Islamic nations such as Turkey, Cyprus, and its neighbours Pakistan and Bangladesh Ã¢Â€Â“ that have all banned instant divorce. So they are bound to come and put some block to it, or they want to forestall the proceedings and all that. But, ultimately the Supreme Court will succeed in giving a good law.
